Prof A. I. Samatar and his fallacy on the new life in Mogadishu

In response to Professor Abdi Ismail Samatar’s article entitled “UN threatens the Somali democratic movement” which he raised a number of questions including what is a Roadmap? And who is Spoiler?

While the TFG welcomes constructive criticism and encourages discussions and debate on the proposed new political dispensation, blaming the International Community for our own mistakes serves no purpose. We must accept responsibility for our actions and be creative in finding solutions, recognising that these ultimately lie within us. It is time to seriously debate and discuss issues that matter to all the Somali people.

In this regard, it is instructive to note that it was the TFG who originally issued statement on the issue of spoilers and we are very grateful for the support from the International Community, such as UN, AU, IGAD and the US.

I am sure most of Somalis are fully aware of what the Roadmap is and who the spoilers are but, for the benefit of the readers, please allow me to respond to the questions posed by the professor and to shed light on the issues he has raised.

The Roadmap

The Roadmap in question is the plan adopted in Mogadishu in September 2011 by representatives of various political entities within Somalia on how to move the country in the direction of peace, stability, and democratic governance. It lays the path to the inauguration of a new political dispensation and to ending the 12 year transition process.

The plan has four components or sets of priorities, namely: security; political outreach and reconciliation; the adoption of a provisional constitution; and good governance. Indeed, the very absence of such a comprehensive, detailed and strategic plan is one of the reasons that Somali politics have been held hostage to a seemingly endless series of transitional governments. It is plain that such a society cannot plan for a economically, politically and socially sustainable future.

Prime Minister Dr. Abdiweli Mohamed Ali accurately described the situation in his policy statement on the adoption of the Roadmap. “Since 2000, successive transitional governments have been presented with shopping lists of deliverables numbering close to 20, from security, peace, good governance, DDR, health care provision, the building of civil administrations on and on. The list was too long, too unfocused and too unrealistic for it to be built into workable benchmarks. Our strategy in consultation with other stakeholders was to streamline the deliverables into manageable and realistic goals and encapsulate them with complimentary policy directions matched by clear timelines through a concisely mapped out Road Map.’’

This therefore is the true significance of the Roadmap. It prioritizes all the many seemingly incoherent policy goals set out by previous administrations into key priority benchmarks that, taken together, will deliver a new political order.

As the Prime Minister stated: “Benchmarks 1, 3 and 4 are tasks that shall be engaged in for many years – we will continue to improve the security of the nation, engage in political outreach and reconciliation; and we will always work to improve the good governance of public institutions.

Benchmark 2 serves two purposes. One, the constitution making process will have significant legal and political arrangements and instruments designed to assist in ending the transition. Two, the constitution making process will lead to a provisional federal constitution which through dialogue and constitutional conferences will serve as a compliment to the reconciliations efforts of the TFG and our partners. Our key priorities are finalizing the draft constitution in order to provisionally ratify through a Constituent Assembly (CA) and to select members of the next parliament by end of June 2012.

Completing our constitutional process and convening our new parliament is how we will reach our new political dispensation and end the transition. Therefore, we must place even more emphasis and effort on this area – my government has been prioritizing these tasks.”

Contrary to the Professor’s assertion that Somalis “find the constitution anti-Somali, and view the entire Roadmap which is supposed to lead to the post-transition political order utterly illegitimate,” the National Consultative meeting held in Mogadishu on 4—6 September 2011 was historically the first time Somali stakeholders came together inside Somalia to discuss issues of importance to Somalia. This is proof of Somali leadership, ownership and unity from the very start.

Professor Samatar’s critique also ignores the fact that the Roadmap was endorsed by Somali civil society organisations in a conference in Mogadishu held from 26 to 28 November 2011 and in the Garowe II conference. These groups continue to contribute to the process.

Even following its adoption by the Constituent Assembly, the constitution will be a provisional one pending its adoption by the people in a referendum. However, it will provide the legal framework for the next administration to arrange for one as well as continue to consolidate the progress we have made in the peace process.

The Spoilers

The Transitional Federal Government has also been clear on who we consider to be spoilers. They are those attempting to obstruct the peace process and to put the prospect of future stability in Somalia into jeopardy. A spoiler is anyone who uses violence to perpetuate the status quo of statelessness or to return the country to the era of warlordism. However, anyone who engages in peaceful political activities, and who freely expresses his/her views, cannot be considered a spoiler.

People have every right to raise their concerns with the constitution provided that they are not using violence or mobilizing clans for their personal gains. The government invites the people to debate on the constitution; the government wants and seeks consultations and constructive criticism. After all, the constitution ultimately belongs to the people of Somalia and there is still scope in the current draft for any necessary amendments, corrections or alterations which would be of benefit to Somali society.

The urgent issues that we now need to tackle are the following:

Ending the transition by August 2012 so we will once again have a permanent government and can rejoin the community of nations. This cannot be achieved without an agreed constitution. So how can we use the remaining time constructively to ensure that the people have a say in making the necessary amendments to the constitution?
How do we differentiate genuine debates / discussions and those warlords who seek to frustrate the entire enterprise by mobilizing clan surrogates to defend their personal interests?
How can we bring about a new political dispensation that can bring a parliament that is leaner, competent, more legitimate and accountable to its people?

Every Somali should have a say in how these issues are addressed and, with patience, I believe every Somali will. The peace process, on which we have laboured for so long, is now bearing fruit. Mogadishu is now flourishing and showing a real sense of peace and hope. Never before have I seen the traffic jams of today on Makka Al-Mukarama Road. Businesses are reopening, buildings are going up everywhere, and the sense of hope within the Somali people is palpable. We continue to make tremendous progress in attaining the targets set out in the Roadmap. There is light at the end of the tunnel. We now have the opportunity to pool our efforts and to get Somalia out of the failed states list for once and all. Should we fail to do this, then blame shall be upon us — and only us.

EU force strikes Somali pirates at home

NAIROBI: European anti-piracy forces have carried out their first air attack on mainland Somalia, strafing a beach from a low-flying helicopter and destroying pirates’ boats, fuel supplies and an arms cache.

The attack is likely to lead to an intensification of the campaign against the multimillion-dollar piracy racket terrorising maritime traffic in the Indian Ocean and damaging international trade, naval intelligence sources have warned.

There are about 300 hostages in the hands of Somali pirates, the Los Angeles Times reported.

The dawn raid, launched from one of nine European warships patrolling off Somalia, was aimed at ”making life as difficult for pirates on land as we’re making it at sea”, a European Union military official said.

The operation was ordered after weeks of surveillance from maritime patrol aircraft and other surveillance planes circling above known hideouts. Five small attack boats were ”rendered inoperable” and pirates said the strike also hit diesel and weapons stores.

No lives were lost in the attack on the base north of Harardhere, 350 kilometres north of Mogadishu, a pirate stronghold, and no Somalis were injured, the EU said. No EU military personnel landed during the mission.

It is the first time European military units have been ordered to attack pirates on land and follows an EU ruling two months ago allowing ”disruptive action against known pirate supplies on the shore”.

”We believe this action will further increase the pressure on [pirates] and disrupt pirates’ efforts to get out to sea to attack merchant shipping and dhows,” said Rear Admiral Duncan Potts, the British operation commander of the EU naval force.

The attack involved several European navies, including seven frigates patrolling off Somalia, from France, Germany, Italy, Spain, the Netherlands and Portugal. Officials said it was ”a European mission” and would not specify from which warship the strike was launched.

”An unidentified helicopter destroyed five of our hunting boats early in the morning. There were no casualties,” one pirate, who identified himself as Abdi, said. ”We were setting off from the shore when the helicopter attacked us. We ran away without counter-attacking.”

A European force spokesman, Timo Lange, said only one helicopter carried out the assault. But local residents reached by phone said more than one helicopter was involved.

Some residents spoke of deep unease they felt over the past few days as aircraft, believed to be European spy planes, buzzed over the town and patrol boats spied from offshore.

”Two nights ago, they came with small speedboats to the seashore of the town, but they went back without shooting,” one resident said. Another said: ”We were preparing to go in the sea for fishing last night, but we heard the noises of helicopters moving upstairs in our sky.”

With the arrival of the French amphibious assault ship Dixmude in the the area soon, the attacks are likely to escalate.

The newly commissioned

vessel is capable of carrying Tiger attack helicopters deployed for sophisticated missile strikes from a safe distance.

”The time is now right to step up the attacks on the infrastructure to put the pirates considerably on the back foot,” said a Royal Navy source.

”However, the Somalis will certainly be better prepared next time round and are likely to defend their bases with significant anti-aircraft assets now they know that the ante has been upped. This will inevitably lead to bloodshed and escalation.”

Former Somali prime minister asks Va. court to rule he is immune from war crimes lawsuit

RICHMOND, Va. — A lawyer for the former prime minister of Somalia told a federal appeals court Wednesday that a judge improperly acquiesced to the State Department’s view that his client can be sued over alleged war crimes.

Mohamed Ali Samantar is appealing U.S. District Judge Leonie Brinkema’s ruling that he is not entitled to immunity from a lawsuit filed in 2004 by several Somalis who claimed they suffered brutal repression, including torture and mass killings, under the regime of dictator Siad Barre. Samantar has denied any wrongdoing.

Samantar was a top official in dictator Barre’s regime, serving throughout the 1980s as vice president, defense minister and prime minister. He left Somalia after the regime’s collapse in 1991 and eventually settled in Fairfax County.

Samantar attorney Joseph Peter Drennan told a three-judge panel of the 4th U.S. Circuit Court of Appeals that the issue of civil immunity for a former official of a foreign state is one for the judiciary, not the executive branch. He said Brinkema simply accepted the State Department’s determination without conducting any legal analysis.

“The government deigned to state what the common law ought to be in this country,” Drennan said. “That is not the call of the executive, it is the call of the judicial department.”

He acknowledged that the executive branch has a foreign relations interest in such matters, but said the State Department failed to explain how granting Samantar immunity could embarrass the U.S. or implicate its foreign policy.

Plaintiffs’ attorney James Tysse argued that the State Department’s determination is entitled to significant deference — and that’s what it got from Brinkema.

He also said the foreign policy concern is clear: “The United States condemns human rights abuses and has a strong interest in protecting human rights.”

Tysse said that if former foreign leaders are awarded civil immunity, the U.S. could become a safe haven for those responsible for atrocities.

Samantar has been trying to assert immunity for years. He succeeded at first, with Brinkema ruling in 2007 that he enjoyed the protection as a former official of a foreign state. But the ruling was overturned on appeal, and the case wound up back in Brinkema’s court after it was reinstated by the U.S. Supreme Court.

In February, citing his failing health and mounting legal costs, Samantar agreed to accept legal liability for the alleged war crimes although he continued to maintain his innocence. Brinkema has not yet entered a default judgment, however, and Samantar is continuing to pursue the immunity claim.

Tysse told the appeals court the immunity argument will be moot as soon as the judge decides the amount of damages and records the judgment, but Drennan disagreed. He said Samantar cannot default in a proceeding he should not have been subjected to in the first place.

The appeals court typically takes several weeks to rule.

EU carries out first air strikes against Somali pirates

The European Union naval force patrolling the Indian Ocean on Tuesday carried out its first air strikes against pirate targets on shore, with a pirate reporting that the raid destroyed speed boats, fuel depots and an arms store.

Somali pirates raided by EU naval forces for the first time

Bile Hussein, a pirate commander, said Tuesday the attack on Handulle village in the Mudug region of Somalia’s central coastline will cause a setback to pirate operations. The village lies about 18 kilometres north of Haradheere town, a key pirate lair. There were no reports of deaths in the attack.

Maritime aircraft and attack helicopters took part in the attacks early in the morning on the mainland, an EU spokesman said. The EU is the main donor to the Somali transitional government. It is also trains Somali army troops, and is reinforcing the navies of five neighbouring countries to enable them to counter piracy themselves.

The long coastline of war-ravaged Somalia provides a perfect haven for pirate gangs preying on shipping off the East African coast.

“This action against piracy is part of a comprehensive EU approach to the crisis in Somalia, where we support a lasting political solution on land,” said Michael Mann, spokesman for EU foreign policy chief Catherine Ashton.

Naval force protects aid ships Since December 2008, the EU has kept five to 10 warships off the Horn of Africa in an operation known as Atalanta.

NATO has a similar anti-piracy flotilla known as Ocean Shield, and other countries — including the United States, India, China, Russia, and Malaysia — also have dispatched naval vessels to patrol the region.

The EU naval force is responsible for the protection of World FoodProgram ships carrying humanitarian aid for Somalia, and the logistic support vessels of the African Union troops conducting operations there. It also monitors fishing activity off the coast of Somalia, which has been without a functioning government since 1991, when dictator Mohamed Siad Barre was overthrown.

In March, the EU adopted a more robust mandate for its naval force, allowing it for the first time to mount strikes against pirate targets on Somalia’s “coastal territory and internal waters.”

At the time, officials said the new tactics could include using warships or their helicopters to target pirate boats moored along the shoreline, as well as land vehicles or fuel tanks used by the pirates.

The EU did not say which member nation’s forces carried out Monday’s raid.

‘Ring of Fire’ Solar Eclipse Occurs May 20

Skywatchers in East Asia and the western United States should circle Sunday (May 20) on their calendars. That’s when a solar eclipse will block out most of the sun, leaving a spectacular “ring of fire” shining in the sky for observers located along the eclipse’s path.

The event is what’s known as an annular solar eclipse — from the Latin “annulus,” meaning “little ring” — and its full glory should be visible from much of Asia, the Pacific region and some of western North America, weather permitting. At its peak, the eclipse will block about 94 percent of the sun’s light.

Other parts of the United States and Canada will still see a partial solar eclipse, without being treated to the ring of fire effect, though the East Coast will miss the event since the sun will have set before it begins. The eclipse will occur in the late afternoon or early evening of May 20 throughout North America, and May 21 for observers in Asia. Solar eclipses occur when the moon comes between Earth and the sun, casting a shadow on our planet. Annular eclipses are similar to total eclipses in that the moon lines up with the sun dead-on. But in this case, the moon is close to apogee — the farthest point from Earth in its elliptical orbit around our planet — so it’s a smidge too small in the sky to cover the solar disk completely. As a result, a ring of bright sunlight will still blaze around the moon’s circumference.

Like other types of solar eclipses, annular eclipses are spectacular but potentially dangerous skywatching events. Care must be taken to observe them properly, or serious and permanent eye damage — including blindness — could result.

Warning: Never look directly at the sun, either with the naked eye or through telescopes or binoculars without the proper filters.

To safely observe the May 20 annular eclipse, you can buy special solar filters to fit over your equipment, or No. 14 welder’s glass to wear over your eyes. Do NOT use standard sunglasses or any kind of homemade sun-shading contraption.

The safest and simplest technique is perhaps to watch the eclipse indirectly with the solar projection method. Use your telescope, or one side of your binoculars, to project a magnified image of the sun’s disk onto a shaded white piece of cardboard.

The image on the cardboard will be safe to view and photograph. Be sure to cover the telescope’s finder scope or the unused half of the binoculars, however, and don’t let anybody look through them.
